1. Acceptance of Terms

By accessing or using PeakStay (“the Service”) at peakstay.io, you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. These terms apply to all visitors, users, and subscribers.

2. Description of Service

PeakStay is a pricing recommendation tool for short-term rental hosts. It analyzes local event data and hotel pricing to suggest nightly rates for upcoming weekends. Recommendations are informational only — they are not financial or business advice. You are solely responsible for the prices you set on your listings.

3. Accounts

• You may use the Free tier without creating an account.
• To save search history or access Starter features, you must create an account with a valid email address.
• You are responsible for keeping your account credentials secure.
• You must be at least 18 years old to create an account.
• We reserve the right to suspend or terminate accounts that violate these terms.

4. Subscriptions and Billing

• The Starter plan is available for $15/month or $126/year, billed through Stripe.
• A 15-day free trial is available. No credit card is required to start the trial.
• After the trial, you may subscribe or your account reverts to the Free tier.
• Subscriptions renew automatically unless cancelled before the renewal date.
• You may cancel at any time via the billing portal. No refunds are issued for partial billing periods.
• We reserve the right to change pricing with reasonable notice to subscribers.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose.
• Attempt to reverse-engineer, scrape, or copy the Service or its underlying data.
• Use automated tools to send excessive requests to the Service.
• Share your account credentials with others.
• Misrepresent your identity or impersonate others.

6. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, express or implied. We do not guarantee that recommendations will result in increased revenue, that the Service will be uninterrupted or error-free, or that event and hotel data will always be accurate or up to date.

7. Limitation of Liability

To the fullest extent permitted by law, PeakStay and its operators shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including lost revenue, lost bookings, or business interruption. Our total liability to you shall not exceed the amount you paid us in the 12 months preceding the claim.

8. Intellectual Property

All content, design, and code on peakstay.io is the property of PeakStay. You may not reproduce, distribute, or create derivative works without our written permission. Your search inputs and results are yours — we do not claim ownership of your data.

9. Third-Party Links and Services

The Service relies on third-party data providers (Ticketmaster, Eventbrite, PredictHQ, Google Hotels) and infrastructure (Supabase, Stripe, Vercel). We are not responsible for the availability, accuracy, or terms of those services.

10. Termination

We may suspend or terminate your access to the Service at any time for violation of these terms or for any other reason at our discretion. You may delete your account at any time by contacting us. Upon termination, your data will be deleted within a reasonable time.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on the site. Continued use of the Service after changes constitutes acceptance of the updated terms.

12. Governing Law

These Terms are governed by the laws of the United States. Any disputes shall be resolved through good-faith negotiation, and if unresolved, in the courts of competent jurisdiction.
